A surrender of a Development Consent is the formal process by which a person voluntarily relinquishes the Development Approval previously granted by Council to undertake a specific development.
Council requires written notice to process the surrender of a consent as per Section 4.63 of the Environmental Planning and Assessment Act 1979 and Section 68 of the Environmental Planning and Assessment Regulation 2021.
Once the surrender of a development consent is processed and accepted, Council will provide an acknowledgement letter confirming that the Development Consent has been surrendered.
All rights and obligations associated with the original development consent will then be extinguished.
Refunds of contributions and/or security deposit bonds will only be considered where the application has been formally surrendered and no works have commenced. If you have received a Construction Certificate (CC) or Notice of Commencement (NOC), your certifier will need to confirm in writing that no works have commenced.
